What is the difference between mala in se crimes and mala prohibita offenses? Mala in se crimes are evil and morally wrong by nature. Mala prohibita offenses are wrong because they are prohibit by law .
What is the U.S. Criminal Code? The set of laws congress has passed that explain what conduct is considered a federal crime and how it's punished.
What is the void for vagueness doctrine? The void for vagueness doctrine holds that a criminal law is unconstitutional if it is too vague for an ordinary person to understand.
why is ex post facto law unconstitutional ? Because it violates fair notice and due process.
why is acts reus required for criminal liability? You can't be punished unless you actually do a crime.
When can an omission count as a criminal act? An omission is criminal if there is a legal duty to act.
How is strict liability different from other crimes? Because it doesn't require proof of mens rea and only has to prove the act occurred.
Why is mens rea important in criminal law? It matters because crimes require proof that the person had a guilty state of mind when committing the crime.
What are the requirement for a self defense justification? Only for a reasonable belief of an imminent threat.
What is the initial aggressor rule? An initial aggressor cannot claim self defense, only if they withdraw from the conflict.
