Section 1.07 Definitions

TermDefinition
Benefit Anything reasonably regarded as economic gain or advantage
Bodily Injury physical pain, illness or any impairment of physical condition
Coercion Threat
Deadly Weapon firearm or anything manifestly designed, made or adapted for the purpose of inflicting death or SBI
Elements of the Offense Forbidden conduct, required culpability, any required result, negation of the exception
Felony offense punishable by death or confinement in a penitentiary
Government the state, a county, municipality, and any branch of the Great State of Texas
Misdemeanor offense punishable by fine, by confinement in jail or both
Official Proceeding any administrative, executive or judicial proceeding that may be conducted by a public servant
Owner a person with title to property or a greater right to possession than the actor
Public Place any place to which the public or a substantial group of the public has access
Public Servant employee or agent of government
Serious Bodily Injury bodily injury causing a substantial risk of death or that causes death, serious permanent disfigurement or protracted loss of a bodily organ
Act bodily movement, whether voluntary or involuntary and includes speech
Penal Institution place designated by law for confinement of persons arrested for, charged with or convicted of an offense
Effective Consent consent by a person legally authorized to act for the owner
Secure Correctional Facility municipal or county jail and facilities of the Texas Department of Criminal Justice
Omission Failure to act
