Misdemeanor Vocab
Term | Definition |

1. Misdemeanor | An offense punishable by incarceration, usually in a local confinement facility, for a period whose upper limit is prescribed by statute in a given jurisdiction, typically one year or less. |
2. Felony | A criminal offense punishable by death or by incarceration in a prison facility for at least one year |
3. Penal Code | Refers to a set of laws which are related to the punishment of crimes and offenses. |
4. Index Crime | includes murder, rape, robbery, aggravated assault, burglary, larceny, motor vehicle theft, and arson. These eight crimes serve as a common indicator of the nation's crime experience because of their seriousness and frequency of occurrence. |
5. Capital Felony | An individual in which the state seeks the death penalty or shall be punished by imprisonment in the Texas Department of Criminal Justice for life without parole or by death. |
6. Murder | The unlawful killing of a human being. Murder is a generic term that in common usage may include first- and second-degree murder, manslaughter, involuntary manslaughter, and other similar offenses. |
7. Criminally Negligent Homicide | A person commits an offense if he causes the death of an individual by criminal negligence. |
8. Manslaughter | the crime of killing a human being without malice aforethought, or otherwise in circumstances not amounting to murder. |
9. Burglary | The unlawful entry of a structure to commit a felony or a theft (excludes tents, trailers, and other mobile units used for recreational purposes). |
10. Arson | Any willful or malicious burning or attempt to burn, with or without intent to defraud, a dwelling house, public building, motor vehicle or aircraft, personal property of another, and so on. |
11. Assault | An unlawful attack by one person upon another. |
12. Larceny/Theft | The unlawful taking or attempted taking, carrying, leading, or riding away of property, from the possession or constructive possession of another. |
13. Robbery | The unlawful taking or attempted taking of property that is in the immediate possession of another by force or violence and/or by putting the victim in fear. |
14. Sexual Assault | unlawful sexual intercourse achieved through force and without consent. |
15. Motor Vehicle Theft | The theft or attempted theft of a motor vehicle. |
16. Aggravated Assault | The unlawful, intentional inflicting, or attempted or threatened inflicting, of serious injury upon the person of another. |
17. Hate Crime | a crime, typically one involving violence, that is motivated by prejudice on the basis of race, religion, sexual orientation, or other grounds. |
