What are the 2 kinds of laws in HC? Civil and Criminal
What is Civil laws? Legal relationships between people -- protects rights.
What is Criminal laws? Dealing with wrongs against society, person, property.
Most medical cases deal with what law? CIVIL
What is a tort? A wrongful act NOT involving a contract -- can be open to different legal interpretations.
When do torts occur? Torts occur when a patient is harmed/injured because a HCW doesn't meet/provide the expected standard of care.
What is malpractice? "Bad practice" the failure to use the degree of skill (professional) expected, resulting in injury.
What is negligence? Failure to give care that is normally expected, resulting in injury.
