| battery | Intentional offensive touching or use of force without consent or legal justification |
| breach of confidentiality | Failure to keep privileged medical information private |
| CAP | College of American Pathologists - organization that offers proficiency testing & laboratory inspection |
| CAPA | Corrective Action Preventative Action - plan that describes corrective & preventative actions needed to address a problem |
| civil actions | Legal actions in which the alleged injured party sues for monetary damages |
| CLIAC | Clinical Laboratory Improvement Advisory Committee - organization formed to assist in administering CLIA regulations |
| CLSI | Clinical & Laboratory Standards Institute - develops voluntary standards & guidelines for the laboratory |
| CoW | Certificate of Waiver - type of certificate for laboratories that perform waived testing only |
| CQI | Continuous Quality Improvement - program designed for continuous monitoring & analyzing to identify processes that need improvement |
| defendant | Person against whom a complaint is filed |
| delta check | Compares current test results with previous results for the same test on the same patient |
| deposition | Process in which one party questions another under oath with a court reporter present |
| discovery | A process in litigation in which both sides exchange information about witnesses & evidence that will be presented at trial |
| due care | The level of care that a person of ordinary intelligence & good sense would exercise under the given circumstances |
| fraud | A deceitful practice or false portrayal of facts either by words or conduct, often done to obtain money or property |
| GLPs | Good Laboratory Practices - ten QA recommendations for laboratories doing waived testing |
| IHI | Institute for Healthcare Improvement - nonprofit organization focused on patient safety |
| implied consent | The patient's actions or circumstances imply consent without a verbal or written expression of consent |
| informed consent | Implies voluntary & competent permission for a medical procedure, test, or medication |
| invasion of privacy | Violation of one's right to be left alone |
| IQCP | Individualized Quality Control Plan - Risk-based, objective approach to QC tailored to the testing in use at the lab |
| ISO | International Organization for Standardization - international organization that develops international standards for many industries, including healthcare |
| malpractice | Type of negligence implying a greater standard of care was due to the injured person |
| negligence | Failure to exercise due care |
| NPSGs | National Patient Safety Goals - components of a CQI program that are required for TJC accreditation |
| plaintiff | Injured party in the litigation process |
| QA | Quality Assurance - established policies & procedures intended to guarantee excellence of patient care |
| QC | Quality Control - use of checks & controls to assure quality |
| quality | The degree of excellence of something |
| quality indicators | Measurements or values that provide information on the effectiveness or quality of processes |
| res ipsa loquitor | The Latin phrase meaning "the thing speaks for itself," which applies to the rule of evidence in a case of negligence |
| respondeat superior | The Latin phrase meaning "let the master respond." Employers must answer for damages their employees cause within the scope of their practice |
| risk management | Process focused on identifying & minimizing risks to patients & employees |
| SAFER | Survey Analysis for Evaluating Risk - acronym for the TJC method used to identify & communicate deficiency risk levels |
| SE | Sentinel Event - unexpected unfavorable event that results in death or serious injury |
| standard of care | The normal level of skill & care that a healthcare practitioner would be expected to adhere to in order to provide due care for patients |
| statute of limitations | Length of time after alleged injury in which a lawsuit can be filed |
| threshold value | Level of acceptable practice beyond which quality cannot be assured |
| TJC | The Joint Commission - accredits & certifies healthcare organizations |
| tort | Wrongful act committed against one's person, property, or reputation |
| vicarious liability | Liability imposed by law on one person for acts committed by another |
