Term | Definition |

assault | act or threat causing another to be in fear of immediate battery. |
battery | intentional harmful or offensive touching of, or use of force on,another person w/o consent or legal justification. Legal justification would be when mother gives permission to have blood drawn from her child. |
breach of confidentiality | failure to keep privileged medical info private. |
civil actions | between 2 private parties suing for monetary damages. |
GLPs | Good Laboratory Practices dev by CLIAC, 10 recommendations for COW labs-not mandatory. |
fraud | deceitful practice or false portrayal of facts, by words or conduct, often to obtain money or property. Ex: billing for services that have not been provided. |
due care | level of care a person of ordinary intelligence and good sense would provide under the given circumstances. |
discovery | Formal process in litigation involving taking depositions and interrogating parties involved. |
QA | Quality Assurance-program to guarantee quality patient care by tracking outcomes thru scheduled reviews for all processes used. |
quality indicators | guides used to monitor all areas of patient care. |
respondent superior | Latin: let the master respond. Employers must answer for damages their employees cause if employee working within scope of employment and has had proper training. |
plaintiff | Injured party in a claim. |
CLSI | Clinical & Laboratory Standards Institute. |
vicarious liability | law imposed by law on one person for acts committed by another. Ex: contractor acting on behalf of employer based on the contract between them. |
QC | Quality Control. |
defendant | Person(s) whom against a complaint is filed. |
statute of limitations | Length of time injured person is permitted to file lawsuit. usually starts 1.day act was committed 2.when the injury was/should have been found by reasonably alert patient 3.day dr/patient relationship ends 4.minors-when minor reaches age of majority |
QSE | Quality System Essentials-12 basic components, used to develop quality mgmt process,universal -applied to simple or complex operations, requires process policies procedures to be written and monitored. Preanalytical Analytical Postanalytical |
standard of care | Normal level of skill and care health care practitioner would be expected to practice to provide due care to a patient. |
invasion of privacy | violating ones right to be left alone. |
threshold values | must have for all Quality Indicators-level of acceptable practice where quality patient care cant be assured. Ex-ER vs. Lab contaminated draws. |
informed consent | voluntary and competent permission for medical procedure test or medication. |
CMS | Center for Medicare and Medicaid Services - agency that manages these federal healthcare programs. |
malpractice | negligence committed by professional (licensed nurse, physician, etc). |
CQI | continuous quality improvement -ongoing effort to improve the quality of service. |
tort | wrongful act, other than breach of contract, committed against one's person, property, reputation or other legally protected right. |
negligence | Failure to exercise due care, doing something a reasonable person would or would not do. |
delta check | comparing current results of a lab test with previous results for the same test on same patient -makes sure equip functioning correctly and w/i guidelines. |
NSPGs | National Patient Safety Goals-part of overall CQI requirements for accreditation. voluntary non-govt agency oldest and largest healthcare standard-setting body in nation. |
deposition | when one party questions another under oath while court reporter records every word. |
Res ipsa loquitur | Latin-let the thing speak for itself. when a breach of duty is so obvious that no further explanation is needed. |
