TermDefinition
Commerce Article 1, Section 8, Clause 3 of the U.S. Constitution, which gives Congress the power “to regulate commerce with foreign nations, and among the several states, and with the Indian tribes.”
Full Faith & Credit Article IV, Section I of the Constitution, that state courts respect the judgments of courts from other states.
Supremacy Article VI, Paragraph 2 of the U.S. Constitution It establishes that the federal constitution, and federal law generally, take precedence over state laws, and even state constitutions.
Due Process Clause found both in the 5th and 14th Amendments that states that a person may not be denied life, liberty or property without the due process of law.
Elastic Article I, Section 8, Clause 18 of the Constitution; one of the powers of Congress that allows them to make any laws that are necessary and proper for carrying out their other powers. Also called the "Necessary and Proper Clause"
Emoluments Article I, Section 9, Paragraph 8) that generally prohibits federal officeholders from receiving any gift, payment, or other thing of value from a foreign state or its rulers, officers, or representatives.
Habeas Corpus Article One, Section 9, clause 2, which demands that "The privilege of the writ of _________ shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."
Free Exercise Clause in the 1st Amendment that states that Congress cannot pass laws that inhibit the free exercise of religion
Establishment Clause in the 1st Amendment that states that Congress cannot establish religion.
Privileges & Immunities Article IV, Section 2 The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States.
