Judicial Branch Vocabulary

TermDefinition
Civil Liberties the basic freedoms to think and to act that all people have and that are protected against government abuse
Civil Rights the rights that involve equal status and treatment and the right to participate in government
Due Process following established and complete legal procedures
Probable Cause the reason for a search or an arrest, based on the knowledge of a crime and the available evidence
Search Warrant a document that gives police legal authority to inspect private property
Civil Law the category of law that covers private disputes between people over property or relationship
Criminal Law the category of law that deals with the breach of law and their punishment
Indictment a formal complaint of criminal wrongdoing
Bail money pledged by a person accused of a crime that he or she will return to court for trial
Bond a financial instrument by which a borrower agrees to pay back borrowed money, plus interest, at a future date
Miranda Warnings a list of certain constitutional rights possessed by those accused of crimes like the right to remain silent
Double Jeopardy being made to stand trial twice for the same offense
Capital Punishment the death penalty
Jurisdiction a courts authority to hear and decide a case
Exclusive Jurisdiction sole right to hear a case, example: Bankruptcy Case
Concurrent Jurisdiction cases that fall under jurisdiction of both state and federal courts
Original Jurisdiction first court to hear the case
Appellate Jurisdiction authority of some courts to review a case
Plantiff person who makes the complaint in court
Defendant person whom the complaint is made against
Precedent earlier court decision that guides decisions in later cases
Chief Justice Justice that is the head of the Supreme Court
Grand Jury Jury to determine if there is enough evidence to have a trial
