Who decides if a person accused of a crime should be charged and stand trial for that crime? grand jury
What is the official charge called that the grand jury issues? indictment
What happens at the initial appearance? The judge decides the amount of bail for the suspect.
What happens at the preliminary hearing? The judge determines if there is probable cause that the suspect was involved in the crime.
What is the correct order for the following? Preliminary hearing, initial appearance, arraignment, booking Booking, initial appearance, preliminary hearing, arraignment
In which pre-trial step does the accused enter a plea? Arraignment. The accused can plead guilty, not guilty, or agree to a plea bargain if one has been offered by the prosecution.
What is the difference between a grand jury and a trial jury? The grand jury decides if there is enough evidence to officially charge (indict) the suspect. The trial jury (petit jury) listens to all the arguments, witnesses, and evidence at the trial and decides if the defendant is guilty or not guilty.
Who has the initial burden of proof in a criminal case? the prosecution / district attorney / the state / the government
If a defendant is found liable in a civil law suit, what would probably be required of her? compensation to the plaintiff
Explain to the two categories of crimes for adults. Felonies and misdemeanors are the two types of crimes. Felonies are more serious crimes that usually result in more than a year in prison and/or more than $1,000 fine. Misdemeanors are less serious crimes that usually result in less punishment.
Challenges to elections are the jurisdiction of which court? Georgia Supreme Court
Which court has original jurisdiction over felonies committed in the county? Superior Court
Which court automatically reviews all death penalty cases? Georgia Supreme Court
Which court handles issues arising from conflict over wills and estates? Probate Court
Which court has original jurisdiction over divorce cases? Superior Court
