what is the first amendment? congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; abridging the freedom of speech, or of the press; the right of people peaceably to assemble, and to petition the government for a redress, grieve
what is the second amendment? a well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed
how about the third? no soldier is required to stay in a home at any time even during war
4th amendment this is where ppl have the right to not let the law into their home for unreasonable search and seizures.. they have ti have a warrant to come in and search
5th amendment no person can be used to witness against them self unless chose to by their self. also a person may never have to go on double jeopardy trial
6th amendment all criminal has the right to a speedy and public trial by a impartial jury of the state where the crime was committed
7th amendment in suits a common law law, where the value of controversy shall exceed twenty dollars, the right of trial by jusry shall be preserved, and no fact tried by jury, shall be other wise reexamined in any court of the united states than according to the rules
8th amendment excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted
9th amendment the enumeration in the constitution, of certain rights shall not be construed to deny or disparage others retained by the people
10th amendment the powers not delegated to the united states by the constitution nor prohibited by it to the states are reserved to the states respectively or to the ppl
what are civil liberties civil liberties are legal and constitutional rights that protect individuals from arbitrary acts of government
gitlow vs. new york 1925 trying to get industrial workers to go on strike
the clear and present danger test act of 1917. a man falsely yelled fire in a theater
limits on free speech u cant slander ppl and u have to be libel it cant be obscene
slander? slander is a spoken defamation that falsely attacks a persons good name and reputation
libel? libel is a written defamation that falsely attacks a persons good name and reputation
symbolic speech? this is voicing a opinion of something by using symbols like signs and clothing
prior restraint? a form of censorship
the exclusionary rule prohibits evidence obtained by illegal searches or seizures from being admitted in court
the right to counsel?
