Voir Dire To question the jury pool-to help find jurors that would help your case.
Prior Restraint The government cannot curve ideas before they are released. They cannot stop the press unless it will harm them.
Gideon v. Wainwright Gideon was denied a lawyer by the state of florida and the supreme court decided that the law was unconstitutional.
Schenck v. United States Charles Schenck printed and distributed secret government documents. The Supreme Court decided that his conviction was constitutional.
Search Warrants A court order authorizing a search.
Search Exceptions If it is an emergency they can search without a warrant.
Double Jeopardy One person cannot be tried for the same crime twice.
1st Amendment "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof..."
2nd Amendment Citizens have the right to bear arms. Many states require permits and waiting periods.
3rd Amendment Soldiers may only occupy private homes during times of war.
4th Amendment Protection against arbitrary searches and seizures without proper warrant or probable cause.
5th Amendment Provides protection against double jeopardy, self-incrimination, and indictment without proper trial.
6th Amendment The right to an attorney, a fair and speedy trial.
7th Amendment The right to a trial by jury in any civil case where the amount of money is above $20.
8th Amendment Protection from excessive bail fines and cruel and unusual punishment.
9th Amendment Citizens have other rights besides those listed in the constitution.
10th Amendment Powers not delegated to the federal government are saved for the state governments.
Exclusionary Rule Evidence obtained illegally cannot be used in the trial.
Establishment Clause Separation of church and state.
Free Exercise Clause Guarantees each person the right to believe in whatever religion they want.
14th Amendement States must follow the constitution and due processes.
Grand Jury The formal device by which a person can be convicted.
Bill of Attainder A legislative act that inflicts punishment without trial. (Not allowed by the constitution.
Habeas Corpus To be brought physically before a judge to be tried for a crime.
Ex Post Facto Charge someone with a law that didn't exist when the crime was committed.
