When was it written? 1781
What was it? It was the first plan of government for the U.S
Why was it written? It was written to give the states a unified government
What were some pros about it? -created a legislative branch (congress) -gave congress power to make laws -gave congress to establish a military -gave congress power to declare war
What were some Cons about it? -no executive branch (president) -no judicial branch (courts) -no unified currency -no power to tax -an unanimous (100%) vote was needed for articals
Why did the articles fail? -created a weak central (national) government -gave the states too much power -the 13 states weren't unified, acted as independent countries
What is the preamble? - intro statement of the US Constitution - states the goals and purposes of the US gov't
Preamble Goal: form a more perfect Union Make the country stronger than it was in the past ex: Abolish slavery
Preamble Goal: Establish Justice Ensure all people are treated fairly under the law ex: judicial branch
Preamble Goal: Insure domestic tranquility To keep peace within the US ex: police, creating laws
Preamble Goal: Provide for the common defense Protect the country from all enemies ex: military
Preamble Goal: Promote the General Welfare Support the happiness and well-being of people in the US ex: Bill of Rights
Preamble Goal: Secure the Blessings of Liberty Guarantee that the US will always be free ex: gov't upholding the Constitution
What was the purpose of the U.S constitution? - establishes the structure of the U.S gov't -protects individual rights and freedoms
Preamble The intro statement- states the goals and purpose of the U.S gov't
Article I (1) -Legislative Branch -Makes laws for the U.S -Congress (house and senate)
Article II (2) -Executive branch -Enforce laws of the U.S -Pres, Vice Pres, 15 Cabinet Departments
Article III (3) -Judicial Branch -Interpret and apply the laws of the U.S -Federal Court System
Article IV (4) Identifies federalism- the division of power between the national and state governments
Article V (5) Identifies the two-step process to amend (change) the U.S Constitution
The Amendment Process Step 1- proposed by 2/3 vote in congress Step 2- ratified by 3/4 of the States
Adopted Amendments -the amendment process is very complex -to date, only 27 amendments have been added to the Constitution
The Bill of Rights -first 10 amendments of the U.S Constitution -guarantees and protects our individual rights
1st Amendment freedom of religion, assembly, press, petition and speech
2nd Amendment right to bear arms
3rd Amendment prohibits the government from housing soldiers in your home
4th Amendment no search or seizures without a warrant
5th Amendment protects rights of people being accused of a crime
6th Amendement right to a fair trial in court
7th Amendment right to have a court trial with a jury
8th Amendment no cruel or unusual punishment
9th Amendment people have other rights that are not listed in the Constitution
10th Amendment powers not listed in the Constitution are given to the states.
