Constitution Terms

TermDefinition
Constitution A written plan of government
Democracy A political system in which the supreme power lies in a body of citizens who can elect people to represent them
Separation of Powers Constitutional division of powers among the legislative, executive, and judicial branches
Checks and Balances A system that allows each branch of government to limit the powers of the other branches in order to prevent abuse of power
Legislative Branch: -the branch of government that makes the laws -includes the Senate and the House of Representatives
Executive Branch -the branch of government that enforces laws -includes the President, Vice-President and cabinet
Judicial Branch -Interprets the laws -includes the Supreme Court and lower federal courts
Federalism A system in which power is divided between the national and state governments
Delegated powers -powers specifically given to the federal government by the US Constitution -the authority to print money, declare war, raise an army and navy
Reserved powers powers given to the state government alone -conducting elections, granting licenses, setting up schools
Concurrent powers powers shared by the national and state governments -making and enforcing laws, taxes, establishing courts
Bill of Rights The first ten amendments to the US Constitution
Amendment A change to the Constitution
First Amendment 5 freedoms: speech, press, religion, assembly, petition
Second Amendment Right to bear arms
Third Amendment No quartering of soldiers during peacetime
Fourth Amendment Protects against unreasonable search and seizure
Fifth Amendment A constitutional amendment designed to protect the rights of persons accused of crimes, including protection against double jeopardy, self-incrimination, etc.
Sixth Amendment A constitutional amendment designed to protect individuals accused of crimes. It includes the right to a lawyer, the right to confront a witnesses, and the right to a speedy and public trial by jury
Seventh Amendment Right to a trial by jury in civil cases
Eighth Amendment: Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
Ninth Amendment People's rights are not just limited to those listed in the Constitution and Bill of Rights
