McCulloch v. Maryland (1819) Congress wants to create a national bank (Congress wins) - By the Necessary and Proper clause, Congress can take any actions that are essential to the power that it has
Marbury v. Madison Marbury and others are appointed to government jobs in the final days of Adams's presidency, but these last minute appointments were never finalized. Marbury sues for his job, Marbury wins, establishes judicial review
Gobbons v. Ogden (1824) who should get a steamboat license?: Gibbons, who got his money from the federal government (supremacy clause), the commerce clause gives the national government exclusive power to regulate interstate commerce.
Wickard v. Filburn (1942) There was a limit on how much wheat someone could grow, Filburn grew too much and by the commerce clause had to give it up even though he wasn't selling it - power of gov. to regulate economic activity
Heart of Atlanta Hotel v. U.S. (1964) The manager of a hotel did not allow Black Patrons to rent rooms: U/S/ Congress won, said they an sue the commerce clause power to force private businesses to abide by the Civil Rights Act of 1964
South Dakota v. Dole (1987) Scetretary of Transportation Dole in SD defended the state's right to have the drnking age be 19, against the Congre's National Minimum Drinking Age Act: Byspending clause, it is constitutional for Congress to force the 21 drinking age on SD
U.S. v Lopez (1995) Lopez has a gun that he is going to sell in a school zone, court rules that possession of a gun in a school zone is not an economic activity, commerce clause can no longer be used in such an indirect way, Lopez wins
U.S. v. Morrison Morrison was assaulted by fellow classmates, and tried to sue her attackers by the Violence Against Women Act: was not enough evidence, Congress could invalidate the section of the Act that gave victims the right to sue their attackers in federal court
National Federation of Independent Business v. Sebelius Huge case that upheld that Obamacare and HCERA were constitutional (+ everyone needing health insurance by 2014), Sebelius (Secretary of health and human services) wins, Congress can enact most rpovisions under Obamacare
