Wer kann Rechte Pflichten haben? Menschen(natürliche Personen), Personengruppen, Kapitalansammlungen oder Gebietskörperschaften.
Von wann bis wann hat ein Mensch Rechte? Von der Geburt an bis zum Tod!
Nenne ein paar Beispiele für Personengruppen, Kapitalansammlungen oder Gebietskörperschaften GmbH, Aktiengesellschaft, eingetragener Verein, Stiftung, Gemeinde, Land, Staat, Handwerkskammer, Innung
Wer ist geschäftsfähig? Definition Geschäftsfähigkeit ist die Fähigkeit einer natürlichen Person, rechtlich bedeutsame Handlungen vorzunehmen.
Welche Personen sind geschäftsunfähig? Kinder bis zum 7. Lebensjahr und Personen, die krankheitsbedingt über einen längeren Zeitraum Ihren freien Willen nicht äußern können.
Welche Personen sind beschränkt geschäftsunfähig? Personen zwischen dem 7. und 17. Lebensjahr. Betreute Volljährige, für die gerichtlich ein Einwilligungsvorbehalt für bestimmte Bereiche angeordnet wurde.
Welche Personen sind voll geschäftsfähig? Personen die das 17. Lebensjahr vollendet haben, also 18 Jahre alt sind. Bei Ausländern gelten die Bestimmungen des Heimatlandes über die Volljährigkeit.
Sind die Willenserklärung bei Geschäftsunfähigen Personen gültig? Nein sie sind nichtig.
Sind die Willenserklärung bei beschränkt Geschäftsunfähigen Personen gültig? Ja und nein, sie sind schwebend wirksam. Eine Einwilligung des gesetzlichen Vertreters ist erforderlich.
Sind die Willenserklärung bei voll Geschäftsfähigen Personen gültig? Ja, sie sind voll gültig.
