Business law criminal law and procedures

TermDefinition
intent the mental state or design with which an act is committed
assault an intentional act that causes another person to apprehend an immediate and harmful or offensive contact
misdemeanor a less serious crime, typically punishable by a fine or a brief period of incarceration in a local jail
felony a serious crime, typically punishable by imprisonment for more than a year or by death
jurisdiction the official power to make legal decisions and judgments
arraignment a criminal proceeding at which the defendant is officially called before a court, informed of the offense charged in the complaint or indictment, and asked to enter a plea of guilty or not guilty
bail the temporary release of an accused person awaiting trial, sometimes on condition that a sum of money be lodged to guarantee their appearance in court
warrant a legal paper, issued by a judge, authorizing the police to make an arrest, search, or seize property
indictment a formal accusation by a grand jury that there is enough evidence for a criminal prosecution
prosecutor a legal representative of the prosecution in states and federal courts
defense attorney a lawyer representing a defendant in a lawsuit or criminal prosecution
plea bargain an agreement between a defendant and a prosecutor, in which the defendant agrees to plead guilty or no contest in exchange for an agreement by the prosecutor to drop one or more charges, reduce a charge, or recommend a specific sentence
probation the release of an offender from detention, subject to a period of good behavior under supervision
parole the release of a prisoner temporarily or permanently before the completion of a sentence, on the promise of good behavior
habeas corpus a writ requiring a person under arrest to be brought before a judge or into court, especially to secure the person's release unless lawful grounds are shown for their detention
