Medical Liability

Medical Liability Vocabulary

TermDefinition
Criminal law Laws that deal with crimes against the state or society (e.g., theft, assault, murder). Punishments may include jail or fines.
Civil Law- Laws that deal with disputes between individuals or organizations (e.g., contracts, property, or medical malpractice cases).
Tort A wrongful act, other than a crime, that causes harm to someone and can lead to a civil lawsuit.
Prudent Acting with good judgment and caution; making wise decisions.
Scope of practice The legal duties, responsibilities, and limits of what a healthcare worker is allowed to do.
Malpractice Professional negligence; when a healthcare worker fails to meet the accepted standard of care & causes harm to a patient.
Liable Legally responsible for something. If found guilty in a civil case, a person may have to pay damages.
Diagnosis The identification of a disease or medical condition based on a patient’s signs, symptoms, tests, and medical history.
Informed consent Permission a patient gives for treatment after being fully informed of the risks, benefits, and alternatives.
Resultant Something that happens as a direct outcome or consequence of another action.
Defamatory False statements that damage another person’s reputation.
