Term | Definition |
Chain of Custody | The witnesses, written record of the people who maintained unbroken control over an item of evidence. (Someone who handled any evidence) |
Arrest | Legally depriving someone of liberty by seizing or touching the person to indicate that they are in custody. |
Appearance Notice | A legal document, usually issued for less serious offense, compelling an accused person to appear in court. |
Bench Warrant | An arrest issued directly by the judge when an accused person fails to appear in court. |
Summons | A legal document issued for an indictable offense, ordering an accused person to appear in court. |
Reasonable Grounds | Information that would lead a reasonable person to conclude that the subject had committed a criminal offence. |
Provincial Court | The lowest level in the hierarchy of Canadian courts. |
Superior Court of Prov | The highest criminal and civil court, consisting of a trial division and an appeal division. |
Appeal | An application to a higher court to review the decision made by the lower court |
Perjury | Knowingly making a false statement in court while giving evidence under oath or affirmation. |
Direct Examination | Testimony given by a witness to prove an alleged fact. |
Circumstantial Evidence | Indirect evidence that leads to a reasonable inference of the defendants guilt. |
Voir-Dire | A mini-trial in which jurors are excluded while the admissibility of evidence is discussed. |
Charge to Jury | The judge’s explanation to the jurors of how the law applies to the case before them. |
Subpoena | A court order requiring the witness to appear in court on a certain date to give evidence. |
Hearsay Evidence | Evidence given by a witness based on information received from someone else rather than personal knowledge. |
Burden of Proof | The crown’s obligation to prove the guilt of the accused beyond a reasonable doubt. |
Arraignment | The first stage of a criminal trial in which the defendant enters a plea to the charge. |
Bail | The temporary release of an accused who posts money or some other security. |
Class Characteristics | The general attributes of an object. |
