Term | Definition |
Liability | A Tort that's based on fault; ex Negligence |
Damages | Often required for a Tort to be enforceable. |
Causation | Defendant's fault must have caused plaintiff's injuries. |
Foreseeable | Proximate cause places a limitation on causation in that the chain of events which caused the action must be ___. |
Factual Cause | Actual chain of events that precipitated the action by the defendant that caused injury to the plaintiff. |
Preponderance of the evidence | In causation, the jury determines whether an average person could have foreseen the result. |
Compensatory | The type of damage that reimburses plaintiff for damages. |
Economic | Damages capable of calculation. |
Non-Economic | Damages which must be estimated, such as emotional and physical pain. Jury must estimate. |
Punitive | Type of damage which seeks to punish certain behavior of defendant with additional fines. |
