Liability A Tort that's based on fault; ex Negligence
Damages Often required for a Tort to be enforceable.
Causation Defendant's fault must have caused plaintiff's injuries.
Foreseeable Proximate cause places a limitation on causation in that the chain of events which caused the action must be ___.
Factual Cause Actual chain of events that precipitated the action by the defendant that caused injury to the plaintiff.
Preponderance of the evidence In causation, the jury determines whether an average person could have foreseen the result.
Compensatory The type of damage that reimburses plaintiff for damages.
Economic Damages capable of calculation.
Non-Economic Damages which must be estimated, such as emotional and physical pain. Jury must estimate.
Punitive Type of damage which seeks to punish certain behavior of defendant with additional fines.
