Was ist ein Handelsvertreter? Ein selbstständiger Kaufmann.
Was macht ein Handelsvertreter? Er schliesst oder vermittelt in fremdem Namen Verträge auf fremde Rechnung ab.
Welche Pflichten hat ein Handelsvertreter? Vermittlung oder Abschluss von Verträgen. Bemühungspflicht. Benachrichtigungspflicht. Sorgfaltspflicht. Befolgungspflicht. Treuepflicht, Verschwiegenheit.
Was versteht man unter der Bemühungspflicht? Darunter versteht man, dass der Handelsvertreter sich im Interesse seines auftragsgebers bemühen muss, Geschäfte abzuschliessen.
Was versteht man unter der Sorgfaltspflicht? Gesetze beachten.
Was versteht man unter der Befolgungspflicht? Er muss Konditionen einhalten, wie z.B. den Preis.
Welche Rechte hat der Handelsvertreter? Recht auf: Unterlagen. Benachrichtigungen. Provisionen. Ausgleich.
Was versteht man unter einer Delkredereprovision? Unter Delkredereprovision versteht man die Provision, die vom Unternehmer ausgezahlt wird, weil der HV die Delkrederehaftung übernommen hat.
Was versteht man unter dem Recht Ausgleich? Wenn der Vertrag zwischen dem HV und dem Unternehmer ausgelaufen, bzw. beendet wurde, dann erhält der HV einen Ausgleich dafür, dass der Unternehmer weiter mit den Kunden Geschäfte macht, die der HV geworben hat.
Welche zwei verschiedenen Arten des HV gibt es? einen Abschlussvertreter und einen Vermittlungsvertreter.
Was versteht man unter einem Abschlussvetreter? Er kann Verträge rechtswirksam abschliessen.
Was versteht man unter einem Vermittlungsvertreter? Er hat einen beschränkte Artvollmacht, beim Abschluss von Verträgen.
Was für ein Vertrag besteht zwischen dem HV und dem Unternehmer? Vertretervertrag.
Wie ist die Dauer der Tätigkeit vom Handelsvertreter? ständig.
