HIPAA Violation Tier Structure

TermDefinition
Tier 1 unknowingly committing a violation
Tier 1 Fine $100 - $50,000 per violation
Tier 1 a violation that the covered entity was unaware of and could not have realistically avoided, had a reasonable amount of care had been taken to abide by HIPAA rules
Tier 2 reasonable cause
Tier 2 a violation that the covered entity should have been aware of but could not have avoided even with a reasonable amount of care
Tier 2 Fine $1,000 - $50,000 per violation
Tier 3 willful neglect
Tier 3 corrected a violation suffered as a direct result of willful neglect of HIPAA, In cases where an attempt has been made to correct the violation
Tier 3 Fine $10,000 - $50,000 per violation
Tier 4 willful neglect
Tier 4 Uncorrected a violation of HIPAA constituting willful neglect. No attempt has been made to correct the violation
