What is the role of solicitors? Conduct litigation, used to have monopoly on conveyancing, can appear in higher courts (advocacy cert), specialise, avoid disputes
What is the role of Barristers? Specialise in advocacy, right of audience in all, work in chambers run by clerk, 'cab rank', instructed by sol, Kings Council
What is fusion? Merging of the two professions
What is the body in charge of discipline for solicitors? Legal Services Act 2007 set up the Solicitors Regulation Authority (disciplinary tribunals)
What is the body in charge of discipline for barristers? Legal Services Act 2007 set up the Bar Standards Board (disciplinary tribunals)
What body oversees regulation of solicitors and barristers? Legal Services Board
What may you sue a barrister/solicitor for? Negligence/breach of contract
Hall v Simons Solicitors/Barristers can be sued for negligence
White v Jones Solicitor negligent in making will
Griffiths v Dawson Solicitor negligent in divorce proceedings
The office for legal complaints against solicitors/barristeers is headed by what body? Legal Services Ombudsman
What is the professional body for barristers? Bar Council
What is the professional body for solicitors? Law Society
What are legal executives? Very similar role to solicitors, but aren't qualified (LPC)
