Activitatea notarială - asigură persoanelor constatarea raporturilor juridice civile sau comerciale nelitigioase, precum şi exerciţiul drepturilor şi ocrotirea intereselor - se realizează de notarii publici prin acte notariale şi consultaţii juridice notariale
Formele de exercitare a funcţiei de notar public a) birou individual; b) societate profesională.
Actul îndeplinit de notarul public, purtând sigiliul şi semnătura acestuia este de autoritate publică şi are forţa probantă şi, după caz, forţa executorie prevăzute de lege.
Notarii publici au obligaţia să verifice, în scopul prevenirii litigiilor ca actele pe care le instrumentează să nu cuprindă clauze contrare legii şi bunelor moravuri, să ceară şi să dea lămuriri părţilor asupra conţinutului acestor acte spre a se convinge că le-au înţeles sensul şi le-au acceptat efectele.
Notarul public îşi desfăşoară activitatea - la sediul biroului notarial în care funcţionează - se poate deplasa şi în afara sediului biroului notarial, în limitele circumscripţiei teritoriale a judecătoriei în care îşi desfăşoară activitatea.
