WHAT IS AN INDICTMENT An “Indictment" is a written accusation by a grand jury, filed with a superior court, that charges one or more defendants with the commission of one or more offenses, at least one of which is a crime, and which serves as a basis for prosecution thereof
WHAT IS A SUPERIOR COURT INFORMATION A “Superior Court Info” means a written accusation by a district attorney filed with a superior court pursuant to CPL which charges 1 OR more def with a commission of one or + off. at least 1 which is a crime, and serves basis for prosecution.
WHAT IS A MISDEMEANOR COMPLAINT A “Misd Complaint” is a written accusation by a person, filed with a local criminal court, charging one or more other persons with the commission of one or more offenses, at least one of which is a misdemeanor and none of which is a felony.
WHAT IS A FELONY COMPLAINANT Fel Compl means the def agreed to be charged without G.J. determining if there was enough evidence for charges to even be filed. They waive their right to have the G.J. hear their case & conceding there is enough evidence for charges.
WHAT IS A PROSECUTERS INFORMATION A "Prosecutor's Information" is a written accusation filed by the District Attorney, either at the discretion direction of a Grand Jury, the direction of a local criminal court, or at the District Attorney's own instance.
WHAT IS A SIMPLIFIED INFORMATION A “Simplified Information” is a short form accusatory instrument, resembling a traffic ticket, in which traffic, parks, and environmental conservation charges may be filed.
WHAT IS AN INFORMATION An "Info" is a sworn to written accusation by a person, filed at a local crim court, charging one or + with commission of one or + off. none are a fel. The Info, supp dep. annexed show allegations to each element of crime on personal knowledge.
