What is Malpractice? | Liability-generated conduct associated with the adverse outcome of patient treatment. |
What is a Breach of Contract? | An unexcused failure to perform the services specified in a contract, either formal or informal. |
What is a Tort? | A legal wrong, other than breach of contract, for which a remedy will be provided, usually in the form of monetary damages. Three types are intentional, negligent, or strict liability. |
What is Negligence? | A type of tort in which an athletic trainer fails to act as a reasonably prudent athletic trainer would act under the circumstances. (Follow athletic training standards) |
Omission vs. Commission? | Omission is a failure to act when there was a legal duty to do so. Commission is an action that violates a legal duty. |
What is Abandonment? | The desertion of a patient-practitioner relationship by the health care provider without the consent of the patient. |
What is actual cause? | The degree to which a health care practitioner's actions are associated with the adverse outcomes of a patients care. |
What is proximate legal cause? | The degree to which the harm caused by a health care practitioner was foreseeable. |
What is Foreseeability? | The ability to project the likely outcome of an act. |
