Term | Definition |
Crime | a punishable offense against society |
Vicarious Criminal Liability | substituted criminal liability |
Felony | crime punishable in state prison for a year or a fine of more than $1000 |
Misdemeanor | crime punishable by a year or less in city jail or a fine of less than $1000 |
White-collar Crimes | crimes committed in the business world |
Probable Cause | a reasonable ground for belief |
Defense | legal position taken by the accused |
Procedural Defense | problems with the way evidence is displayed or how the accused is being treated |
Substantive Defense | discredits facts that the state sought to establish |
Self-defense | the use of the force that appears to be necessary to the victim to prevent harm |
Immunity | freedom from prosecution |
Contempt of Court | action that hinders the administration of justice |
Punishment | penalty provided and imposed by a court |
Plea Bargain | the accused pleading guilty to a less serious crime to drop the charges on a more serious crime |
Indictment | a written accusation |
Arraignment | when the defendant is brought before the court in a proceeding |
Preliminary Hearing | a hearing at which the evidence against the defendant are brought before the court to determine if they should hold a trial |
Bail | a sum of money or property pledged to guarantee that the accused will appear for a hearing or even a trial |
Subpoena | command to an individual to testify or present documents in their possession |
Voir dire | the preliminary exam of potential jurors |
Verdict | the decision of the jury |
