The Americans with Disabilities Act applies primarily, but not exclusively, to “disabled” individuals. An individual is “disabled” if they meet at least one of the following criteria: | They have a physical or mental impairment that substantially limits one or more of their major life activities--They have a record of such an impairment-- They are regarded as having such an impairment |
Employers are required to make reasonable accommodation for qualified individuals with a disability, who are defined by the Americans with Disabilities Act as individuals who satisfy the job-related | requirements of a position held or desired, and who can perform the “essential functions” of such position with or without reasonable accommodation. |
The Americans with Disabilities Act does not require | employers to make accommodations that pose an “undue hardship.” “Undue hardship” is defined as significantly difficult or expensive accommodations. |
