Public Law 94-142 (1975)Education for All Handicapped Children Act (EHA). It required states to provide a FAPE for all children w/handicaps the ages of 3-18 fAPE regardless of the severity of handicap, protection of rights of children/parents w/disabilities in educational decision making, IEP, LRE,& appropriate evaluation.
Individuals with Disabilities Education Act (IDEA) (1990)Public Law 101-476 amendment to PL 94-142 (1975) changed the name of the law to address people-first language,added autism & TBI to the other categories of disabilities. Transition services, promotion of movement from school to post-school activities, were required.
The six guiding principles of IDEA Zero Reject,Protection in Evaluation Free Appropriate Public Education,Least Restrictive Environment,Parent and Student Participation in Decision Making,Procedural Due Process
IDEA reauthorization in 1997 addressed high expectation, ensuring access to general curriculum, strengthening parent roles,coordinating special ed w/all other school improvement efforts, providing services in the reg classroom, supporting teacher prep, reducing the need to label& paperwork.
No Child Left Behind is the reauthorization of the 1965 Elementary and Secondary Education Act (ESEA
No Child Left Behind all children will be proficient in basic skills by 2014.(AYP)taught by “highly qualified” teachers who use methods & materials that are based in scientific research.Accountability
Individuals with Disabilities Education Improvement Act of 2004 Public Law 108-446 Congress' intent in 2004 was that the IDEA move even further by raising expectations so that "to the maximum extent possible, students with disabilities meet the challenging expectations set for all children
Section 504 of the Rehabilitation Act of 1973 Public Law 93-112 provides that no otherwise qualified individual with a disability shall, solely by reason of his or her disability, be discriminated
Section 504 of the Rehabilitation Act of 1973 It defines a person with a disability as one who: has a physical or mental impairment that substantially limits one or more of the major life activities of such individule has a record of such impairment (known history of cancer now in remissiom)is regarded as having such an impairment
Technology-Related Assistance to Individuals with Disabilities Act Public Law 100-407 (1988) The Tech Act authorized federal funds to be granted to the states to create statewide systems for delivering assistive technology and technology service to individuals with disabilities. This law helped states help meet people's needs.
Americans with Disabilities Act - ADA Public Law 101-336 (1990) civil rights protection to persons with disabilities in private sector employment, all public services, public accommodation, transportation & telecommunications makes sure that individuals with disabilities can put their education & training to work.
Training of professionel act 1959 (PL 86-158) trained leaders to educate children with mental retardation
captioned films act of 1958 (PL 85-905) training provisions for teachers of students with mental retardation
teachers of the deaf act 1961 (pl-87-276) trained educational personnal for children who were deaf or hard of hearing
elemantary & secondary eduction act 1965 (PL 89-10)& the states school act (pl-89-313) provided states with direct grant assistance to help educate children with disabilities
Section 504 of the rehabilituation act of 1973 a civil rights law-1st public law specifically aimed at protecting children & adults aganist discrimmination dut to a disability
Section 504 no indivdual can be excluded soley b/c of their from participating in or benefiting from any program or activity receiving federal fincail assistance,which includes schools
section 504 have a physical or mental impairment which substantially limits 1 or more life activties,have a record of such an impairment, & are regarded as having such an imapirment by others
Major life activities include walking,seeing,hearing,working & learning
504 plan an accommodation plan that is customized to meet the unique needs of the indivdual (school create) covers the students life span
What must a 504 Plan contain include a statement of the pupil's strngths & weaknesses,a list of necessary accommodations,& the indivduals responsible for ensuring implementation
Americans with disabilities act (PL-101-336) ADA forbids discrimination aganist persons w/diasbilities in both public & private sectors.any person w/an impairment that substantially limits a major life activity is covered.(1990 George H.W Bush)
What is the major difference between Section 504 and the ADA? Section 504 only applies to entities that receive federal financial assistance. Whereas the ADA covers most establishments whether privately owned or assisted with state and/or federal funds
