Which Texas practitioners does Dr. C identify as having independent prescriptive authority? Physicians, dentists, podiatrists, veterinarians, and appropriately licensed therapeutic optometrists/optometric glaucoma specialists within their scope.
For dangerous drugs (non controlled) what situations are not allowed in terms of sending in a script? 1) RPh can't call in a verbal as a prescriber, only as a delegate 2)Canadian/mexican providers cant send electronic/fax/verbal scripts (must only be paper)
Can a Texas pharmacist fill an out-of-state dangerous drug script from a podiatrist/physician/dentist/t-optometrist/glaucoma specialist/veternarian? Yes, as long as they are liscensed in the US and are prescribing within their scope
What are the rules for scripts from canadian/mexican providers? Must be written script, must be a physician/dentist/podiatrist/vet
Can out of state NP/PA send scripts to Texas pharmacies? Yes, as long as delegating physician info is documented.
For C3-5 scripts, who can never prescribe in Texas? -out of state NPs/PAs -Canadian/mexican providers -Pharmacists
Who CAN write scripts for C3-5 drugs in Texas? All US-based Physicians/vets/DDMs/podiatrists In-state PA/NPs (90-day max) with attending DEA T/TGs (3-day max)
For C3-5 prescribing, for the providers allowed to write scripts for these drugs, can these approved providers use any method of prescribing? (ie Electronic/written/fax/verbal) Yes, if they are allowed to write for these meds, they can use any method of prescribing for C3-5s

When are scripts from PAs/NPs required to have attending DEA #? For all controls (not needed for non-controls)
When do written scripts require an official TSBP form? For C2s only
What is the rule for faxed scripts for controls? Must have a manually signed signiture on the faxed script
In what forms can mid-level providers send scripts for controls? They can use any method, electronic/written/fax/verbal for all controls as long as they follow the rules from the table.
What are the situations in which a midlevel provider can write for a C2? Admitted to the hosptial for intended stay of 24+ hours Patient is in the ED Terminal illnesses under hospice care
Can T/TGs write scripts for oral/parenteral drugs for for glaucoma? T: No, only eye drops TG: Yes, can prescribe oral/parenteral meds
Which professions are strictly limited to their scope of practice? Dentists, vets, and podiatrists, and T/TGs can only prescribe for specialty *Physicians can treat any human conditions even if it falls outside their specific specialty
Can a provder write a prescription for office use? No, must order the drug from the manufacturer/wholesaler
What can a pharmacist do for a patient's script if the provider dies/retires under texas law? Non-controls: Can give a 30 day supply C3-5: May give a 72 hour supply C2: nothing
Does texas law prohibit self prescribing for dangerous and/or controls by a physician? No, but professional standards may impose limits Texas Medical Board calls it improper
What are the rules (from the TMB) for a family or self prescription of a control by physicians? No more than 72-hours
How can a pharmacist legally dispense an opioid antagonist? 1) under valid Rx 2)under standing order to a person at risk or their family/friends
Can DXM containing script be sent for a patient under 18? Yes
Does DXM containing OTC meds requiring ID of the purchaser? Yes
What are the Texas rules for abortion related meds? Cannot be dispensed/prescribed with the intent to cause an abortion. Can be given for non-abortion uses
Are gender-affirming care or drugs for kids strictly banned in texas? Yes
In texas, can a pharmacist dispense ivermectin w/o a script? Yes, under a standard procedure
Can pharmacies participate as a donor of donated drugs? Yes, but not for controls
Can midlevel providers operate independently in a free standing medical clinic if it is owned by a LTCF or hosptial? No
What is the limit/ratio for attendings:NP/PAss? Cant be more than 1:7, unless in underserved areas OR in a hospital/LCTF
May a PA/NP prescribe for a patient less than 2 years old? Yes, but MUST consult with attending and document it in the chart
