Absolute vs. relative Our rights are not absolute (total) b/c they have limits to them (rights = relative) → you can’t say/do whatever you want if it breaks the law or harms others
Clear and present danger test If you say or do something that causes harm or breaks the law, then it is no longer protected under the 1st AMD Ex: Falsely shouting fire or bomb in a public area
Civil liberties Natural rights - by being born or by being human, everyone has these rights Gov’t tries to take away CL, so ppl/BOR/Const. have to protect them Ex: Freedom of speech, freedom of religion, freedom of the press
Civil rights Legal rights you get by being a part of a country/society Other ppl try to take away your CR, so gov’t must protect them Ex: Right to vote, right to due process (your right to be treated fairly by the gov’t)
American Civil Liberties Union (ACLU) An organization that fights for ppl’s civil liberties in court Not biased in who they defend, so sometimes they defend controversial ppl: Neo-Nazis, KKK, LGBTQ+, women, BIPOC, prisoners Main goal: Protect everyone’s rights against the gov’t
National Association for the Advancement of Colored People (NAACP) An organization that fights for civil rights in court Originally created to fight for Black rights against segregation They defend groups who have similar values: BIPOC, LGBTQ+, women, immigrants
14th AMD Protects ppl from gov’t discrimination
Due Process Clause Located in the 14th AMD States have to follow the BOR and give ppl their civil liberties
Equal Protection Clause Located in the 14th AMD State gov’ts have to protect everyone fairly and not discriminate against anyone + protect ppl’s civil rights
Process of incorporation Any decisions that the SC makes about BOR, then the states have to follow based on the 14th AMD’s DPC
First Amendment religion - believe in what you want speech - say whatever you want press - write whatever you want + reporters can write about the gov’t assembly - Gathering and protesting right to petition - tell the gov’t what changes you would like about laws/p
Establishment Clause About freedom of religion - written for the gov’t Gov’t cannot establish an official religion for the US Gov’t cannot favor or harm any religion Gov’t cannot give $ to religion
“A wall of separation between church and state” About freedom of religion - related to the Establishment Clause By Thomas Jefferson Religion and gov’t should be separate from each other - religion should not influence gov’t laws
Free Exercise Clause About freedom of religion - written for the ppl You can believe in whatever you want, unless it breaks the law
Symbolic speech Expressing your opinion or message through nonverbal actions Ex: flag burning, body language, wearing clothing/accessories, protesting/gathering, gestures
