Checks and balances Allows one branch of government to limit the power of another branch.
Presidential veto Prevents a bill from becoming a low and checks the power of congress
Overriding a veto Allows a bill to become a law and checks the power of the president
Judicial review Allows the courts to determine constitutionality and checks the power of congress and the president ( Laws are null and void the power if the courts decide a law is unconstitutional).
Who nominates the judges but ratify the treaties? The president nominates judges, but the Senate must ratify these treaties.
Who negotiates the treaties, but ratify the treaties? The president negotiates treaties, but the Senate must ratify these treaties.
The house of representatives can impeach who? Public officials, but the Senate must conduct a trial to determine guilt or innocence.
Federalism Requires the states and national government to share power. Under the American System the federal gov can wage war and state gov can enfore traffic laws
Individual rights Refer to freedom of individual persons and the protection of minorities from the majority ( freedom of speech and religion)
Who states power should have checks and balances? Baron de Montesquieu
Legislative Branch Bicameral Congress with a House of Representatives and a Senate.
Who passes laws? Congress passes laws and appropriates money.
Legislative Branch The House of Representatives has sole power to impeach (formally accuse). and the Senate must conduct a trial to determine guilt of innocence. The Chief Justice of the supreme Court presides over the trial.
Legislative Branch The necessary and proper clause allows Congress to make laws to carry out its power.
Judicial Branch Judicial review allows the Supreme Court to decide if cases are constitutional or unconstitutional ( Marbury v. Madison allows for judicial review.
Executive Branch Is led by the president and carries out the laws
Executive Branch The president has Cabinet secretaries and their staff to assist him/her
