Unit 4 Vocab

Civil Law

assault: To attack physically; to threaten or attempt to cause injury to someone else. When contact occurs as well, the offense is often called assault and battery.
conversion: The tort of wrongfully taking another person’s property and assuming ownership of it or preventing the owner from using it.
defamation: An intentional publication or public statement of false information that damages someone’s reputation.
litigant: A party to a lawsuit; a plaintiff or defendant.
strict liability: Tort liability imposed regardless of actual fault on a person or company that sells a product for injuries due to defective or dangerous products;
trespass: To enter or disturb property owned by someone else without the owner’s permission.
battery: wrongful and intentional physical touching that causes offense and possibly, though not necessarily, injury
damages: Money awarded as compensation for injury or loss.
false imprisonment: The tort of detaining someone intentionally and without justification.
negligence: Failure to use the proper care in doing something, i.e., the amount of care that an ordinarily prudent person would use under the same circumstances.
tort: A private injury or wrong; a violation of a socially recognized duty owed to a plaintiff that results in injury to the plaintiff; torts can be caused intentionally, through negligence, or under strict liabilit
