Civil Laws Regulates relations between individuals or groups
Civil Action Lawsuit that person brings who feels they have been wronged or injured by another person
Defendant Person accused of committing the crime
Plantiff Person or company harmed
Prosecutor Side bringing the case
Beyond a Reasonable Doubt If jury has and doubt about guilt they must vote not to convict
Preponderance of Evidence The standard of proof
Limited Government Limitation of government power
Separation of Power The three branches (legislative, judicial, & executive) checks and balances
Statues Law making power of Congress
Checks and Balances Branches have power to restrain other branches
Veto Refusal to approve
Judicial Review Can declare and passed law unenforceable based on Constitution
Unconstitutional Violates rights of Constitution or Constitution does give power
Bill of Rights Principle of limited government
Ordinances Local laws or regulations
Supremacy Clause All laws must abide by Constitution
Bills Enact new laws or to amend or repeal existing ones
Legislative Intent Judge who interprets means of legislation
Public Hearings Give individuals or businesses time to express their views on the proposal
Trials Conducted by courts
Appeals/Appellate Courts Higher Courts
Precedent Sets a scene for future similar cases
Treaty An agreement or contract between countries
Extradition One country asks another to surrender a suspected or convicted criminal
Trial Courts Listen, consider, and decide facts in situation

Plaintiff Party bringing legal action in CIVIL TRIAL
Prosecutor Government initiates case in CRIMINAL TRIAL

Adversarial System US trial system, two sides competing against eachother
Inquisitional System European system, judge controls the court
Plea Bargain Pre-trial agreement which disposes case without trial
Voir Dire Lawyers question jurors to find any preconceived opinions
Removal for Cause Opposing lawyers can request removal of any juror
Peremptory Challenges Attorney can have prospective jurors removed without reason
Appeals Court Party asks court to review decision of trial court
Errors of Law Judge makes a mistake as to law applicable in the case
Dissenting Opinion Reasons for judges disagreement
Concurring Opinion Judge agrees with majority, but for different reasons
Probate Cases with wills and claims vs estate of people who die with or without a will
Inherent Powers Power to regulate family relationships, trial membership, and law and order on tribes
Delegated Power Congress granted power like environmental regulation
Petitions for Certiorari Request of lower courts records to be sent up
Stare Decisis Rule that precedent must be followed
Due Process of Law Fair treatment
Ligators Trial attorneys
Bar Association Organization that licenses lawyers
Retainer Down payment on total fee
Contingency Fee Percent of the amount client settles for
Attorney-Client Privilege Whatever you tell your attorney about the case is private and confidential
Legal Malpractice/Disbarred Client sues lawyer for serious error which ends can end in lawyer losing their license
