How does the necessary and proper clause relate to the concept of implied powers? Explain. The Necessary and Proper Clause allows Congress to make laws needed to carry out its listed powers. Because of this, Congress has implied powers these powers are not explicitly written in the Constitution but necessary to do its job
What have been some positives and negatives of Congress’ commerce clause? Positives: Allow national regulation of the economy, strengthen federal authority, support a uniform national market negitive: can expand federal power too much reduces state sovernty
How did the 17th amendment impact Congress? Do you believe this was a good addition to the Constitution? Explain why or why not this changed how senators were chosen from being selected by state legislatures to being elected directly by the people. This was a good change because senators make decisions that affect the people, so voters should have the power to choose them.
Do you believe there are times when the president should or must disregard the Constitution in order to do what is best for the people? No because the constitution was made for the american people and there is not many instances where the constitution has to be broken to be able to do what's best for the people
What was the War Powers Act? How did it impact presidential power? Passed over Nixon’s veto and Requires the president to report troop deployment within 48 hours and remove troops after 60 days unless Congress approves this was designed to limit presidential war power
Can you give 2-3 examples of misuse of power by the other branches and explain how the other branches responded to said overreach? example 1 executive ovvereach which means presidents may block documents or testimonys. When was the last time we declared war? Is this an issue? The last offical declaration of war by congress was during world war 2 in 1942. This was a problem because presidents now make war decisions that congress was supposed to control.
Are there powers that the president has that are “uncheckable”? The closest thing to uncheckable is the pardon power. The president can issue pardons and commutations for federal crimes. It's ¨ uncheckable¨ because congress cannot overturn a pardon, courts cant review or block it, and no one can veto or undo it.
