Enforcement Legal Terminology

TermDefinition
Answer Written denial of the allegations in the motion and a request that all relief plead for be denied.
Show Cause A court order directing a person to appear and bring forth any evidence as to why the remedies stated in the order should not be confirmed or executed.
Due Process The regular administration of the law, according to which no citizen may be denied his or her legal rights and all laws must confirm to fundamental, accepted legal principles, as the right of the accused to confront his of her accusers.
Contempt Willful disregard or disobedience of a court's lawful orders committed by one who is under the court's authority as a party to a legal proceeding.
Precept A written order to a sheriff or constable to serve a legal document upon a person.
Service of Process The delivery of a writ or summons to a party for the purpose of obtaining jurisdiction over that party.
Pleading A formal statement, usually written, setting forth the cause of action or defense of a case.
Review and Adustment Process in which current financial information is obtained from both parties in a child support case and evaluated to decide if a support order needs to be adjusted.
Jursidiction The legal authority which a court or administrative agency has over particular persons and over certain types of cases, usually in a defined geographical area.
Citation A summons, especially to appear in court.
Waiver of Service A document which substitutes for service of process, which may be executed after a lawsuit is filed.
