QuestionAnswer
Civil Liberties Individual rights and freedoms that the gov can't interfere on. Guaranteed by the Bill of Rights.
Bill Of Rights First 10 amendments in the constitution that protects fundamental freedoms.
First Amendment Part of the bill of rights. Prevents congress from making laws that infringe on your freedoms.
Fourteenth Amendment Granted citizenship to all persons born in the United States. Guaranteed equal protection under the law. Contains the due process clause.
Due Process Clause Found in the 5th and 14th amendment. Protects individuals from being deprived of life, liberty, and property without due process (Fair Procedures)
Incorporation Doctorine Uses the 14th amendment and due process clause to apply protections under the Bill of Rights to states. States cannot infringe on these rights.
Establishment Clause First amendment. Gov cannot create or establish a formal religion or can they put a religion on anyone else. Separation of church and state.
Free Exercise Clause First amendment. People are allowed to practice their religion freely without government interference, as long as it does not conflict with public morals or laws.
Prior Restraint Gov action that prevents speech or publication before it happens. Generally considered unconstitutional, but may by allowed.
Libel False written statement that damages a persons reputation. Not considered freedom of speech.
Symbolic Speech Nonverbal actions that express political or social ideas. Protected in first amendment.
Commercial Speech Speech or advertisement intended to promote a product or a service. While protected by the First amendment, its subjected to more regulation then most.
Probable Cause Belief that a crime has been or will be committed, justices police in making an arrest or conducting a search. Required by 4th amendment for search and warrants.
