What is the purpose of the Health Records Act 2001 (Vic)? To protect the privacy of individuals’ health information and ensure it is collected, used, and stored responsibly in Victoria.
Who does the Health Records Act 2001 apply to? Applies to both public and private sector organisations in Victoria that handle health information, including hospitals, clinics, and allied health providers.
What principles are contained within the Health Records Act 2001? It includes 11 Health Privacy Principles (HPPs) that regulate how health information is managed.
What is considered ‘health information’ under the Act? Any information about a person’s physical, mental, or psychological health, disability, medical history, or healthcare services received.
What does HPP 1 – Collection state? Health information must be collected lawfully, fairly, and with consent, and only when necessary for a health-related purpose.
What does HPP 2 – Use and Disclosure require? Health information can only be used or disclosed for the primary purpose it was collected, unless the individual consents or law requires it.
What does HPP 3 – Data Quality ensure? Health data must be accurate, complete, and up-to-date before use or disclosure.
What does HPP 4 – Data Security state? Health information must be protected from misuse, loss, or unauthorised access, and destroyed when no longer needed.
What does HPP 5 – Openness require? Organisations must have a clear, publicly available policy on how they handle health information.
What does HPP 6 – Access and Correction provide? Individuals have the right to access their own health information and request corrections if it is inaccurate or incomplete.
What does HPP 9 – Transborder Data Flows regulate? Health data sent outside Victoria must be protected by equivalent privacy safeguards in the receiving jurisdiction.
What does HPP 10 – Sensitive Information state? Sensitive health data must be handled with extra care and only collected with informed consent.
