Term | Definition |

court hierachy | sets out the seniority of each court in terms of the seriousness of the cases that it can hear and whether its decisions can be reviewed by other judges. |
Supreme Court | The Supreme Court is the highest court in that State or Territory. Supreme Courts will conduct jury trials for indictable offences but this is generally only for very serious offences, such as murder. |
County court | County Courts are the next level up from the Magistrates Court. County Courts will also conduct appeals from the Magistrates Court. These courts also conduct criminal trials with juries for indictable offences. There is a judge. |
Magistrate’s Court | Magistrates’ Courts hear less serious matters, like traffic offences, and are heard by a Magistrate. |
High Court | he High Court is the highest court in Australia. Any appeal that goes to the High Court will be on a question of law only and special permission is required. There are up to 7 judges that may hear an appeal and decide |
Federal Court | The Federal Court will hear criminal matters that are created by federal legislation. That is, legislation that applies to all States and Territories. They have judges and use juries in criminal matters |
