Legal Rights and Responsibilities

TermDefinition
Common Law A system of law that is based on precedent and customs
Precedent A ruling used in judicial cases in later and similar cases
Statutes A law written by a legislative branch
Plaintiff A person or party filing a lawsuit
Defendant An individual or group being sued or procicuted
Felonies A serious crime
Misdemeanors A relatively minor crime
Larceny A crime is which you take someones property with n intent to return it
Robbery The forceful taking of someones property
Burglary Unlawful entry into any dweller or structure
Lawsuit A legal action in which a person is sues to collect damages for harm that is done
Torts Wrongful actions in which the affected has the right to sue
Libel Written untruths that can harm someones reputation
Constitutional Law Branch of law dealing with the constitution
Stare Decisis The practice of using earlier rulings as a basis to decide a case
Writ of Habeas Corpus A court order in which requires police officers to tell their detainee why they are being detained
Bills of Attainder A law that applies someone without a fair trial or court
Ex Post Facto Laws A law that says someone should be punished for a law that isn't active that currently is active
Due Process of Law A fair way through the court system
Search Warrant Document that allows authorities to search you or your property
Double Jeopardy Someone is charged with a crime they have already been convicted of
Grand Jury A group of citizens that decides whether there is sufficient evidence to convict a person
Plea Bargaining Negotiation between the defense attorney and the prosecutor
Bail A sum of money used as security if someone tries to run away
