RESEARCH SKILLS: Laws and Regulations

Explain the difference between laws and regulations and their respective authorities Laws-are statements of public policy voted on and passed by the U.S. Congress and signed by the President. Regulations- are written by ATF employees, signed by the Director of ATF, and approved by the U.S. Attorney General, derive authority from law
4 Elements for a Correct Citation of a regulation. 1. The Code of Federal Regulations title number. 2. Abbreviation for Code of Federal Regulations being “CFR.” 3. The part number (followed by a period.) 4. The section number.
Identify the subject areas relating to ATF that are found in Title 27 of the Code of Federal Regulations Title 27 ‐ Alcohol, Tobacco Products and Firearms • 27 CFR Part 447 – Importation of Arms, ammunition and Implements of War • 27 CFR Part 478 – Commerce in Firearms and Ammunition • 27 CFR Part 479 – Machine guns, Destructive Devices, etc

What is CFR? Code of Federal Regulations The entire body of Federal regulations, written by all the Federal agencies.
The entire body of Federal law is called the United States Code (U.S.C.).
TITLES OF THE U.S.C. pertaining to Crimes and Criminal Procedure Title 18- Title I Firearms, Explosives, and Contraband Cigarettes
TITLES OF THE U.S.C. for Internal Revenue Code Title 26 Title II firearms which are National Firearm Act Firearms.

Federal regulations are called Code of Federal Regulations (CFR)
Regulations are codified by subject matter, into one of the many titles of the CFR.

Purpose of Procedures establish methods for licensed industry members for performing operations
INDUSTRY CIRCULARS used to communicate important information to industry members.
INDUSTRY MEMORANDUMS Performed a similar function to Industry Circulars. Issued by the ATF field offices to particular segments of an industry and usually addressed matters or problems peculiar to a region.
OPEN LETTERS • address matters related to a particular region or entire industry. • Issued by ATF Enforcement Programs and Services Branch
NEWSLETTERS primary means of communicating with industry members in less formal way.
What information do Fact Sheets provide? Usually related to one topic and provide specific detail to that pertinent topic.
OPEN SOURCE RESEARCH It is research that exhausts any publicly available information. •Used To obtain the most complete information possible of the research target. •Caveat…You may not find all information needed when initially sought. The search may be ongoing
