Deceptive Advertising & Regulations

Puffery Words Advertisers use of exaggerated claims to make something sound better than it is.
Weasel Words Advertisers make a claim seem legitimate by using words such as help or virtually.

Deceptive advertising A representation, omission, or practice that is likely to cause a substantial segment of potential customers to have a false belief about the advertiser’s or a competitor’s product.
Federal Trade Commission The main governmental regulatory agency for advertising.
Demographic Segmentation is based on... Age, Gender, Education, etc.
Psychographic Segmentation is based on... Social Class, Personality, Lifestyle, etc.
Patent The grant of an intellectual property right to the inventor to exclude others from making, using, or selling the invention throughout the United States without permission for a limited time in exchange for public disclosure of the invention.
Copyright A form of protection provided to the authors of original works of authorship including literary, dramatic, musical, artistic, and certain other intellectual works, both published and unpublished.

Trademark A word, name, symbol, or device that is used in trade with goods to indicate the source of the goods and to distinguish them from the goods of others.
Food & Drug Administration Responsible for protecting the public health by ensuring the safety, efficacy, and security of human and veterinary drugs, biological products, and medical devices; and by ensuring the safety of our nation's food supply.
Securities & Exchange Commission These federal agencies mission is to protect investors; maintain fair, orderly, and efficient markets; and facilitate capital formation.
The Federal Communications Commission Regulates interstate and international communications by radio, television, wire, satellite, and cable in all 50 states, the District of Columbia and U.S. territories
Geographic Segmentation is based on... City, Country, Population Density, etc.
Behavioral Segmentation is based on... Purchasing Habits, Spending Habits, Customer Loyalty, etc.
Securities & Exchange Commission Protects investors, promotes fairness in the securities markets, and shares information about companies and investment professionals to help investors make informed decisions and invest with confidence.
National Advertising Review Board The appellate body for the U.S. system of advertising industry self-regulation.
