Term | Definition |

Civil Rights | The basic legal rights held by all U.S. citizens. |
Constitutional Rights | The rights afforded to all citizens through the U.S. Constitution |
Human Rights | The fundamental rights of all people regardless of citizenship status |
Litigation | The legal proceeding in court |
Public Law | Issues between a government and its citizens -Involves 3 main categories -Criminal Law -Constitutional Law -Administrative Law |
Civil Law (Private Law) | Focuses on issues between private citizens, such as medical malpractice |
Common Law | A traditional civil law of an area or region resulting from ruling by judges on individual disputes or cases |
Statutory Law | Laws that are enacted by federal, state, and local legislators and enforced by the court system |
Tort | Any wrongful act that results in harm |
Restitution | The amount payed from the damage of another person that you caused (car crash) |
Unintentional Torts | Accidents or mistakes that result in harm |
Intentional Torts | Acts intended to cause harm |
Assault | A threat or attempt is made to touch a patient without his or her permission |
Battery | A non-consenting patient is actually touched |
Invasion of Privacy | A provider who intentionally and unreasonable exposes a patients body or reveals a patients personal information without consent |
False Imprisonment | Any attempt to restrain an individual or restrict his or her freedom |
Defamation of Character | Making false or malicious statements that do harm to a persons reputation |
Libel | When the information is written |
Slander | When the information is spoken |
Negligence | Careless or senseless behavior by a healthcare practitioner that results in harm |
Malpractice | Involves any illegal, unethical, negligent, or immoral behavior that results in failure of duties or responsibilities on the part of a healthcare professional |
Informed Consent | When patients are given information about their care or voluntarily consent to particular treatments or procedures |
Implied Consent | When a patient doesn’t sign a written statement but gives permission for care to be provided, or is assumed to have given permission if unconscious |
Legal Guardian | Someone appointed by a judge to act for another person, such as a minor or mentally incompetent adult |
Ward | The person who is under legal guardianship |
Health Insurance Portability & Accountability Act (HIPAA) | This protects a patients personal health information from being used or shared without a patients written consent |
Living Will | Documents in steps, if any, are to be taken in order to save or prolong a persons life |
Incapacitated | A person who is unable to make his or her own medical decisions |
Durable Power of Attorney for Health Care | A designated person who makes health care decisions on behalf of the patient in the event the patient becomes incapacitated |
Ethics | The reflection of values of a certain group |
Professionalism | A set of values, behaviors, & relationships that form a foundation on which a patient & colleague trust is formed |
