Administrative Law Body of rules created by government regulatory agencies
Case Law Based on an appealed case ruling, an appellate court sets precedence for future cases
English Common Law Product of custom-based laws being unified by England
Ethics Deciding what is a right or wrong action in a reasoned, impartial manner
Greatest Good Examines whether the action will cause the greatest good for the greatest number of people
Law of Precedent When a judge is required to follow an earlier court decision when deciding a case with similar circumstances, also called stare decisis, “let the decision stand”.
Statutory Law Act of a federal, state legislature or local government that declares, prescribes, or commands something. Specific law expressed in writing.
The Golden Rule “Do unto others as you would have them do unto you”
Consequential Ethical Reasoning Making ethical decisions based off the consequences to the action - Alternative ways to change the current situation -Evaluates each alternative -Generates the greatest good
Rule Based Ethical Reasoning -Fundamental ethical rule -Either a recognized authority or human reasoning - Acts themselves are judged as right or wrong
Ethics as Reflected in U. S. Laws and the U. S. Constitution Laws are judged to be right or good when they affect the majority of the people in a positive manner
Executive Branch President and Vice President; implements and enforces laws
Judicial Branch U.S. Supreme Court; decides constitutionality of bill/law from legislative branch, and whether action from executive branch exceeds their powers, if so, they can void it.
Legislative Branch U.S. Senate and U.S. House of Representatives; makes laws
Federal Bureau of Investigation (FBI) Law enforcement agency that upholds the law through investigation of violations of federal crime statutes
North Carolina State Bureau of Investigation (SBI) Division of NC Department of Justice; Assists local law enforcement with criminal investigations
