NYS P.L. BURGLARY & RELEVANT DEFINITIONS

DEFINITION OF PREMISES "Premises" includes the term "building," as defined herein, and any real property
DEFINITION OF BUILDING "Building," includes any structure, vehicle or watercraft used for overnight lodging of persons, or used by persons for carrying on business therein, elementary, secondary school, an enclosed motor truck, or an enclosed motor truck trailer.
DEFINITION OF DWELLING "Dwelling" means a building which is usually occupied by a person lodging therein at night
DEFINITION OF NIGHT "Night" means the period between thirty minutes after sunset and thirty minutes before sunrise.
DEFINITION OF ENTER OR REMAIN UNLAWFULLY Enter or remain unlawfully." A person "enters or remains unlawfully" in or upon premises when he is not licensed or privileged to do so. .
DEFINITION OF TRESPASS Trespass. A person is guilty of trespass when he knowingly enters or remains unlawfully in or upon premises
TRESPASS IS WHAT TYPE OF CRIME Trespass is a violation
DEFINITION OF INTENT The design or purpose to commit a wrongful or criminal act
P.L. 140.10 Criminal trespass in the third degree. A person is guilty of Criminal Trespass 3RD when he knowingly enters or remains unlawfully in a building or upon real property. (a) which is fenced or otherwise enclosed , where the building is utilized as an school or a children`s overnight camp.

TRESPASSING ON AN OVERNIGHT CHILDRENS SUMMER CAMP IS WHAT OFFENSE ? Criminal Trespass 3RD Degree "B' MISD when he knowingly enters or remains unlawfully when the building is utilized as an children`s overnight camp.
TRESPASSING INSIDE A FENCED IN AREA DESIGNED TO KEEP OUT INTRUDERS IS ? A person is guilty of CRIMINAL TRESPASS 3RD DEGREE "B" MISD when he knowingly enters or remains unlawfully in a building or upon real property (a) which is fenced or otherwise enclosed in a manner designed to exclude intruders.
YOU ARE IN A ELEMENTARY SCHOOL AND THE VICE PRINCIPAL TELLS YOU TO LEAVE THE PREMISE AFTER AN ARGUEMENT. YOU REFUSE TO WHAT CRIME HAVE YOU COMMITTED ? CRIMINAL TRESPASS 3RD "B" MISD: Remaining in an elementary or secondary school in violation of a personally communicated request to leave the premises from a principal, custodian, school board member or trustee, or other person in charge thereof.
YOU ARE VISITING A FRIEND IN A HOUSING PROJECT AND THE HOUSING OFFICER TELLS YOU TO LEAVE BUT YOU REFUSE WHAT CRIME ARE YOU COMMITTING ? CRIMINAL TRESPASS 3RD "B" MISD: where a building is used as a public housing project in violation of a personally communicated request to leave the premises from a housing police officer or other person in charge thereof;
YOU ARE HANGING OUT BY THE RAILROAD IN VIOLATION OF A POSTED "NO TRESPASS RAILROAD ZONE" WHAT CRIME ARE YOU COMMITTING ? CRIMINAL TRESPASS 3RD "B" MISD: where the property consists of a right-of-way or yard of a railroad or rapid transit railroad which has been designated and conspicuously posted as a no-trespass railroad zone
