QuestionAnswer
The Family and Medical Leave may provide up to a total of twelve (12) work Weeks
or 480 work hours of unpaid leave
A work week is defined as an employee’s normally scheduled hours of work each week
2. The definition of a work week may vary for employees who work in an area requiring a 24–hour operation
such as: Patrol, Corrections or the Communications Center
FMLA leave usage is measured/tracked on a “rolling 12–month period”
which is measured backward from the date an employee first uses any FMLA leave
Depending upon the circumstances FMLA leave may be paid or unpaid
depending upon the accrued leave (e.g., personal, annual or sick leave – see applicable leave plan) available to the employee.
FMLA leave is not necessarily granted in addition to other forms of leave
Leave taken under the City’s Personal Leave Plans or Leaves of Absence may qualify for, and be applied towards, an employee’s FMLA leave entitlement
The City will designate any absence taken for a qualifying reason as FMLA
and count that time against an employee’s 12–week FMLA entitlement
Approved Family and Medical and Leave may be paid, unpaid, or a combination of both
All employees with more than 80 hours of available leave will be placed on FMLA paid leave until their available leave balance reaches 80 hours
Thereafter, such employees shall choose either to continue with paid leave to cover the remainder of their FMLA time
or alternate to a FMLA leave without pay status
An employee can utilize intermittent leave when it is taken in separate blocks of time due to a single qualifying reason
