What is the result if a federal law conflicts with the U. S. Constitution? What if a state constitution or law conflicts with the U. S. Constitution? What if a state constitution or law conflicts with federal law?
What case did I discuss in class that establishes the Supreme Court's power to review acts of Congress? What doctrine did it establish and what does it mean?
What are the limitations on Government that we discussed?
What is due process? What 2 word definition did I give you? (FUNDAMENTAL FAIRNESS) Outline what you know about due process. (Begin with where we find this limitation and what the 2 minimum due process requirements are)
What is equal protection? Outline what you know about equal protection. (Begin with where we find this limitation and include whether this is a imperative - can people be treated differently, if so, when?)
What do you know about privileges and immunities? To what does this apply?
I expect you to know the body of the Bill of Rights and the freedoms that we enjoy under these amendments. I will not ask you what is found in the 6th amendment (for example).
How do the Constitutional personal freedom guarantees found in Amendments 4, 5, 6, 8 and 14 apply to businesses? Which are the same? Which is different? How and why the difference?
