Why can't protestors protest on private residencies? It takes someone else's right to privacy away.
Are protestors allowed to protest on private property? No.
Why can't pro-life groups protest near abortion clinics? It takes away the woman's right to have an abortion.
Can pro-life groups protest very close to abortion clinics? No.
What does "Pro-life" mean? Against abortion.
What are two possible reasons of why a group couldn't assemble? 1) Disrupts people's right 2)Disrupts traffic.
What is Literal right to assemble? Come together to make a statement.
What happened in the video game ruling? Stores can't sell or rent, violent or obscene to a minor without a parent or guardian there.
What is Libel? Implying something false that damages someone's reputation.
What was Times VS. Sullivan? Public figures had to prove times was saying damaging things about Sullivan.
Who sued Hustler magazine? Falwell.
What happened in Texas VS. Johnson? Supreme court made a law that you couldn't burn the flag for Freedom of Speech.
What is symbolic speech? A non speaking way of showing how you feel about something.
What is a conscientious objector? People who won't allow protest because of beliefs.
What are two examples of Free Exercise clashing with society's norms? 1)Amish parents often refuse to send kids to public school. 2)Jehovah's witnesses and Christian scientist refuse to accept blood transfusions and other medical treatment for themselves or children.
What does FECA do? Gives as much money as they want. (Freedom of expression.)
What does the BCRA do? Helps one person.
What famous TV/radio host got fined multiple times for indecency on a radio. Howard Stern.
What does the FTC do? Regulates commercial speech.
What happened in Miller VS. Cali? Miller sent porno's in mail, old lady opens one and calls the cops. The court said he can't send anything out that is obscene.
What is the communication decency act? People under 18 shouldn't see obscene materials/\.
What year was there a video game ruling> 2011.
What is Free Exercise? The government can't interfere with your practice of religion.
What was KY 10 commandments VS. Texas? KY had the 10 commandments hung up on a court house, Texas got mad.
What did Texas have? Different religious monuments.
What government party opposes school prayer? Democracy.
What government party supports school prayer? Republicans.
Where is non student lead prayer unconstitutional at? -Graduation -Games
What was Engel VS. Vitale? You can't have school prayer.
When was Engel VS. Vitale? 1962
What was the 10 commandments ruling? The federal government says you can't hang the 10 commandments inside a classroom.
When was the 10 commandments ruling? 1980.
What does sectarian mean? Religious Groups.
What does Secular mean? Non Religious.
What's the Free exercise clause? The government can't interfere with your practice of religion.
What is the establishment clause? Congress can't make a law supporting or against religion.
What do religious extremist believe? Their religion is the only one.
What's a totalitarian government? State holds authority over society, government controls all aspects of life.
In a totalitarian government, what holds authority over society? States.
What is Freedom of Expression (FOE) Your freedom to speak, worship, petition, assemble, and tell the press.
Who ran Parochial schools? Churches.
When was parochial school? 1755.
What is peaceably assemble? Peaceful gathering to make a statement.
What does the FCC do? Regulates the content and nature of radio and TV.
What is FCC? Federal communications commission.
What is FTC? Federal Trade Commission.
What amendment is freedom of expression? 1st amendment.
Is it illegal to shout "Fire!" in a crowded theatre? Yes!
Why can't you shout fire in a crowded theatre? Because it causes panic.
What is hate speech? Something you say that attacks a persons religion, looks, relationship, ETC...
What's prior restraint? The government taking action, preventing material from being published. EX: Scandal,porn
Who is usually getting hate speech? Gays, blacks, Mexican, atheist, Muslims.
What is considered obscenity? Offensive things or items the society agrees is bad.
What amendment does not protect obscenity? 1st amendment.
