What was James Madison's idea for the bill of rights? people felt as if their rights were not adequately protected by the Constitution. James Madison proposed the ides of the bill of Rights to gain the peoples trust and lay a solid foundation
What is the first way an amendment is proposed? amendment is proposed by congress by a 2/3 vote in both houses.
What is the second way an amendment is proposed? proposed at a national convention called by congress when requested by 3/4 (34) of the state legislatures
Describe step two in the amendment process it's ratified by the state legislatures of 3/4 (38) of the states. Or it is ratified by conventions held in 3/4 of the states.
Where did the idea for the Bill of rights come from? James Madison and the other federalists promised the anti federalists That the bill of rights would be added to the Constitution in the form of amendments.
The 5th amendment persons indicated for committing a serious crime such as murder must be accused by a grand jury. there, it will be decided whether there is enough evidence to put the person on trial.
double jeopardy (5th amendment) a person who has been found not guilty of a crime cannot be put on trial again for the same offense
Miranda warning any accused person has the right to remain silent. They might say they refuse to answer because it might appear to make them guilty. confessions must be freely given, not forced.
6th amendment Is the right to a trial by jury. a citizen is guaranteed the right to public and fair trial. accused person cannot be kept in jail while waiting for trial. has the right to ask questions of any witness
7th amendment permits jury trials in which the cases are conflicts over property and money.
8th amendment an accused person cannot have unfair treatment both before and after a trial.protects people from cruel and unusual punishments. amount of bail can't be unfairly high
10th amendment powers not given to the national government belong to the states or to the people.
What are the different groups of amendments in the bill of rights? The second, third, fourth and fifth all help protect citizens from the abuse of power. The 6th and 7th amendments reflect the belief that a trial by jury is important if people have trust and confidence in the law.
5th amendment part 2: government's possession of private land for public use. the government is allowed to take away your private property for others public projects. The 5th amendment however says that to protect from abuse of power, the government must pay the owners of the property a fair price.
What are the five individual freedoms in the 1st amendment? freedom of speech, press, assembly, petition, and religion.
freedom of petition any citizen or group of citizens has the right to ask a government representative to change a law, make a new law, or solve other problems. may send request by email, letter.
fourth amendment search and seizures. search warrant is a written permission from a judge.
second amendment All citizens have a right to keep and bear arms.
