Fundamentals of nursing

Is a standard or rule of conduct establised and enforced by the government. Intended chiefly to protect the rights of the public. Law
A legislative body enacts statutory law. Statutory laws must be in keeping with both the federal constitution and the state constitution. Ex. is Nurse Practice Acts Statutes
This agencies have the power to make administrative rules and regulations in conformity with enacted law, that acts as laws and enforceable. Board of Nursing is example of this in a state level. Administartive Law
Evolved from accumulated judiciary decisions. Is a court made law. Based on the principle of "stare decisis" or " let the decision stand". Ex. Is Malpractice Common Law
Process of bringing and trying a lawsuit, Litigation
A person or govenment bringing suit against another Plaintiff
The one being accused of a crine or tort Defendant
Refers to ways in which professional competence is ensured and maintained Credentialing
Name 3 process of credentialing accreditation, licensure,certification
Term generally used to describe negligence by professional personnel Malpractice
Performing an act that a reasonably prudent person under similar circumstances would not do or conversely, failing to perform an act that a reasonably prudent person under similar circumstances would do. May be an act of omission or commission. Negligence

One party makes derogatory remarks about another person that diminish the other party's reputation. Defamation of character
Is an assault that is carried out and includes every wilful, angry and violent or negligent touching of another persons body or clothes of anything attach to or held by that other person. Ex. Battery
Is a threat or an attempt to make bodily contact with another person without the persons consent. Assault
When a nurse fails to initiate proper precautions to prevent patient harm (falls,skin breakdown) negligence
